GENERAL TERMS AND CONDITIONS OF SALE

ARTICLE 1 – Identification of the Seller (Legal Notice)
These General Terms and Conditions of Sale (GTC) are concluded between:

The Buyer: Any non-professional individual (consumer) making a purchase via the website www.abyss-ceramics.com.
ARTICLE 2 – Purpose and Acceptance of the GTC
These GTC govern the sale of handcrafted ceramic items by the Seller to the Buyer. Any order placed on the Website implies full and unconditional acceptance of these GTC, which is confirmed by the mandatory checkbox during the ordering process.
ARTICLE 3 – Products and Essential Characteristics
3.1. Handcrafted Nature
The Seller offers entirely handmade ceramic items. Consequently, each piece is unique, and variations may occur compared to photographs (slight differences in glaze color, shape, dimensions, weight, or small imperfections). These variations are inherent to the artisanal manufacturing process and cannot be considered a defect of conformity. The Buyer acknowledges and accepts this specificity at the time of ordering.
3.2. Care Instructions
Stoneware is dishwasher-safe, but hand washing is recommended to preserve the glaze’s shine.
Items are microwave-safe except for gilded pieces (gold, platinum).
3.3. Availability
Products are offered for sale subject to available stock. In case of unavailability, the Seller will inform the Buyer.
ARTICLE 4 – Price and Order
4.1. Price
Prices are indicated in Euros, inclusive of all taxes (VAT included). Delivery costs are not included, charged additionally, and displayed before final order validation.
4.2. Order Validation
Order validation by the Buyer is completed by clicking the button “Order with obligation of payment” (or any equivalent wording) at the final payment stage.
ARTICLE 5 – Payment
The price is payable in full on the day of the order using the payment methods offered on the Shopify site: Credit card, PayPal.
Retention of Ownership Clause: Ordered items remain the property of the Seller until full and final payment has been received.
ARTICLE 6 – Delivery
6.1. Delivery Areas and Fees
Items are delivered within Europe. Delivery fees are calculated automatically and displayed before order validation.
6.2. Delivery Times
The maximum delivery time is 30 days from the order date, unless another timeframe has been expressly agreed.
6.3. Delivery Issues (Damage)
The Buyer must check the condition of the packaging and items upon receipt. In case of breakage due to transport, the Buyer must file a claim with the carrier within 3 business days of delivery and inform the Seller by email, attaching photos of the damaged parcel and broken items. The Seller then undertakes to resend an equivalent piece or refund the Buyer, depending on availability.
ARTICLE 7 – Right of Withdrawal
7.1. Period
In accordance with Article L. 221-18 of the French Consumer Code, the Buyer has a period of 14 calendar days from receipt of the item to exercise the right of withdrawal without having to provide reasons or pay penalties.
7.2. Exclusion (Customized Ceramics)
The right of withdrawal does not apply to goods made according to the consumer’s specifications or clearly personalized (Article L. 221-28 of the Consumer Code). Consequently, custom orders are neither exchangeable nor refundable.
7.3. Return Procedure
The Buyer informs the Seller of the decision to withdraw by email and returns the item at their own expense to the following address: retours[@]abyss-ceramics.com. The product must be returned in its original condition, complete, and in packaging that ensures safe transport without risk of breakage.
ARTICLE 8 – Legal Guarantees
All products benefit from the Legal Guarantee of Conformity (Articles L. 217-3 et seq. of the Consumer Code) and the Guarantee against Hidden Defects (Articles 1641 et seq. of the Civil Code).
ARTICLE 9 – Dispute Mediation
In case of dispute, the consumer Buyer has the option to use the consumer mediator designated by the Seller free of charge:

ARTICLE 10 – Applicable Law and Jurisdiction
These GTC are governed by French law. In case of dispute, and after failure of any attempt at amicable resolution, the competent jurisdiction will be determined in accordance with the French Code of Civil Procedure.
